1. Agreement to Terms
By accessing or using KikaPay's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.
2. Services Description
KikaPay provides ethical invoice financing services to small and medium businesses in Tanzania. We use a Sharia-compliant service fee (Ujrah) model, advancing funds against valid invoices, contracts, purchase orders, and similar commercial documents, subject to our approval process and transparent fee structure. Our fees cover administrative and verification services - we do not charge interest.
3. Eligibility
To use our services, you must:
- Be a registered business operating in Tanzania
- Be at least 18 years of age
- Have valid commercial documents from credible clients
- Provide accurate and complete information
- Have a valid bank account for fund disbursement
4. Service Fee Structure
KikaPay uses a transparent 3-tier administrative and verification fee structure (Sharia-compliant Ujrah model):
- Lite: Invoices 500,000 - 1,500,000 TSH = 100,000 TSH service fee
- Standard: Invoices 1,500,001 - 3,000,000 TSH = 200,000 TSH service fee
- Premium: Invoices 3,000,001 - 5,000,000 TSH = 250,000 TSH service fee
These are one-time service fees covering document verification (30%), risk assessment (25%), administrative processing (20%), collection management (15%), and business support (10%). No interest charges. Repayment is due when your invoice matures (when your client pays).
5. Document Submission
When submitting documents for financing, you represent and warrant that:
- All documents are genuine and have not been altered
- The work or goods described have been or will be delivered
- You have the right to receive payment under the document
- The document has not been previously financed or assigned
- There are no disputes regarding the underlying transaction
6. Approval Process
All financing requests are subject to our approval process, which includes AI-assisted document verification and risk assessment. We reserve the right to approve, reject, or request additional information for any application. Pre-approval does not guarantee final approval or funding.
7. Repayment
Repayment is due when your client pays the invoice. You agree to:
- Direct your client to pay into the designated KikaPay collection account
- Notify us immediately if there are any payment issues or disputes
- Cooperate with our collection efforts if payment is delayed
- Repay the advanced amount if the invoice is not paid within the agreed period
8. Invoice Maturity & Repayment
Repayment is due when your invoice matures - that is, when your client pays the invoice. Each invoice is tracked independently based on its maturity date. You may submit multiple invoices, and each one is subject to individual approval.
9. Prohibited Activities
You agree not to:
- Submit fraudulent, forged, or altered documents
- Finance the same invoice through multiple sources
- Misrepresent your business or transaction details
- Use our services for money laundering or illegal activities
- Attempt to circumvent our security or verification systems
10. Liability Limitation
KikaPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount of fees paid by you in the 12 months preceding the claim.
11. Intellectual Property
All content, trademarks, and intellectual property on our platform are owned by KikaPay or our licensors. You may not copy, modify, or distribute our materials without written permission.
12. Termination
We may suspend or terminate your access to our services at any time for violation of these terms, suspected fraud, or any other reason at our discretion. Outstanding obligations survive termination.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania. Any disputes shall be subject to the exclusive jurisdiction of the courts of Tanzania.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through our platform. Continued use of our services after changes constitutes acceptance of the new terms.
